Common questions
What happens if I don’t have an LPA?
If you lose mental capacity without one, your family may have to apply to the Court of Protection to become your deputy. That usually takes much longer and costs more than making an LPA now. Find out what happens without an LPA.
Who can be my attorney?
Anyone aged 18 or over who has mental capacity and whom you trust, such as a partner, adult child or close friend. For a property and financial affairs LPA, they also can’t be bankrupt. Read our guide to choosing attorneys.
I have an Enduring Power of Attorney. Do I need an LPA?
An EPA made before October 2007 still works, but it only covers money and property, can’t have replacement attorneys, and was designed before online banking. If you can still make your own decisions, replacing it with new LPAs is usually the better choice. Compare your options.
Do I need a solicitor?
No. You don’t need a solicitor to make an LPA, but mistakes can lead to it being rejected. That’s why we check every one before you sign.

How long does registration take?
The Office of the Public Guardian currently takes 8 to 10 weeks to register an LPA if there are no mistakes. That includes a legally required four-week wait, so anyone who was told about the LPA can raise concerns.
